County Declaration of Emergency

GRAYS HARBOR COUNTY RESOLUTION NO. 2020-023

A RESOLUTION of the Grays Harbor County Board of Commissioners declaring a county emergency in Grays Harbor County related to the novel coronavirus (COVID-19) pandemic

WHEREAS, on February 29, 2020, the Governor of Washington State proclaimed that a state of emergency exists in all counties in the state of Washington for the Novel Coronavirus (COVID-19) Pandemic; and 

WHEREAS, on March 11, 2020, the World Health Organization declared that the spread of the COVID-19 virus had created a global pandemic; and

WHEREAS, COVID-19 has the potential to adversely affect the health of people in Grays Harbor County; and

WHEREAS, the Grays Harbor County Health Officer and the Director of Grays Harbor County Public Health reported to the Grays Harbor County Board of Commissioners on  March 2, 2020, that COVID-19 can result in serious impacts to the health and well-being of the public and could overwhelm the health and medical system in Grays Harbor County; and   

WHEREAS, under the above referenced conditions there is substantial likelihood of risk to the citizens of Grays Harbor County and the cities therein unless further efforts are taken to reduce the threat; and

WHEREAS, the conditions stated above constitute an emergency/disaster for the County, necessitating activation of the Grays Harbor County Comprehensive Emergency Management Plan and the utilization of emergency powers granted pursuant to RCW 36.40.180, RCW 38.52.070(2), and RCW 38.52.110(1),

NOW THEREFORE, BE IT HEREBY RESOLVED BY the Board of Commissioners of Grays Harbor County, Washington as follows:

Section 1. There is hereby declared an emergency, as defined in the Grays Harbor County Comprehensive Emergency Management Plan (PLAN), due to the imminent spread of Coronavirus (COVID-19) Pandemic in Grays Harbor County.

Section 2. Pursuant to the emergency declared at Section 1 and RCW 38.52.070(2), the public advertising and competitive procurement requirements of state law are waived relating to County contracts for the following purchases or leases:

a.    Tangible personal property;

b.    Public works as defined by RCW 39.04.010; and

c.    Services, including professional or technical services.

Section 3. Pursuant to the emergency declared at Section 1, as designated pursuant to the PLAN, all County offices and departments are authorized to assign personnel, enter into contracts and incur obligations necessary to combat such emergency to protect the health and safety of the citizens of the County, and provide emergency assistance to the victims of such emergency, consistent with the PLAN, not to exceed $300,000.

Section 4. The declaration of a local emergency set forth at Section 1 shall terminate at midnight following the 90th day after the date this resolution is adopted unless extended or terminated earlier by the Grays Harbor County Board of Commissioners.
